Max 2008 and directx 10 Problem Help

guys My max 2008 crashes when i enable Direct x 10
i have Ati 3870 and Vista Sp1
with Direct x 9 it is working fine
any help is appreciated

sorry with some googelin' found out Max 2008 and even 2009 are not compatible with direct x 10
